Protection Against Misrepresentation, Entrapment, and Unjust Targeting of Foundational Black Americans (FBA)

1. Non-Organizational Status & Lineage-Based Identity
Foundational Black American (FBA) is a historical, lineage-based designation referring to the descendants of Black individuals who were enslaved and emancipated in the United States. FBA is not an organization, political group, activist movement, or entity with a leadership structure. It is solely a cultural and ancestral identity that reflects the unique history and contributions of this lineage to American society.
Accordingly, individuals who identify as FBA do so based on their lineage and cultural heritage—not due to any affiliation with an organized group, political ideology, or collective membership. No single individual, influencer, or public figure speaks on behalf of all FBAs, nor does any FBA hold authority over another person’s identity or actions.
2. Prohibition Against Mischaracterization and Criminalization
Any attempts to classify, criminalize, or otherwise misrepresent FBA as a structured organization or extremist group are legally unfounded, defamatory, and constitute deliberate misinformation. The weaponization of law enforcement, intelligence operations, or media narratives to falsely link FBA identity with criminal activity or collective liability shall be considered an act of defamation and malicious persecution.
The targeting, harassment, surveillance, or legal persecution of individuals solely based on their identification as FBA constitutes civil rights violations and may be subject to legal action under U.S. law, including but not limited to:
3. Official Stance on Entrapment and Online Manipulation
We are aware of ongoing efforts by various actors—including state-sponsored intelligence agencies, social media disinformation networks, and infiltrators—who deliberately frame FBA as a group rather than a lineage. These COINTELPRO-style tactics include:
All such actions violate federal laws against entrapment, civil liberties violations, and state-sponsored misinformation campaigns. FBA influencers and individuals reserve the right to pursue legal remedies against any government agency, media entity, or individual engaged in such fraudulent behavior.
4. Affirmation of First Amendment Rights & Legal Protections
Every individual identifying as FBA maintains full constitutional protections under the First Amendment, including freedom of speech, association, and self-identification. Any governmental or private entity attempting to criminalize or stigmatize the FBA identity violates these fundamental rights.
Furthermore, individuals or organizations misrepresenting FBA for political, financial, or legal manipulation may be held accountable for intentional infliction of emotional distress, defamation, and civil rights violations.
